I. Introduction

This Personal Data and General Confidentiality Agreement (the "Agreement") is a legally binding agreement between you ("User") and Xania Media (“Company”), the entity which owns and operates XaniaHosting.com (the "Website"). This Agreement outlines the responsibilities and obligations related to the access, use, processing, and protection of personal data and confidential information acquired or disseminated through the Website.

II. Definition of Personal and Confidential Information

1. Personal Data: This refers to any data or information that relates to an identified or identifiable natural person ("Data Subject"). Personal data includes, but is not limited to, names, addresses, email addresses, and financial information.

2. Confidential Information: This encompasses all non-public data, trade secrets, proprietary information, and other confidential material that the User may obtain from the Company during the term of use of the Website and the Services.

III. Obligations of the Company

1. Data Collection: The Company will collect personal data in a fair and lawful manner and will clearly inform the User of the purpose for which data is collected directly or indirectly through its Privacy Policy.

2. Data Usage: The use of personal data will be solely to fulfil the services offered by the Website, such as domain name registration, SSL certificate provisioning, and hosting services, or as explicitly consented to by the User.

3. Data Security: The Company commits to implementing and maintaining reasonable security measures to protect personal data from unauthorized access, disclosure, alteration, or destruction.

Xania Hosting block outgoing traffic on ports 25 and 465 by default for several important reasons:
Spam Prevention: Port 25 is the standard SMTP port used for sending email. By blocking it, we try to prevent compromised servers from being used to send bulk spam emails. This is one of the most common ways malicious actors abuse cloud servers - they compromise them and turn them into spam-sending machines.
IP Reputation Protection: When servers send spam, it can get the hosting company's entire IP ranges blacklisted by email providers and anti-spam services. This would negatively impact all customers using those IP addresses, making it harder for legitimate users to send emails.
Abuse Mitigation: Blocking these ports significantly reduces the hosting provider's infrastructure being used for email-based attacks, phishing campaigns, and other malicious activities that rely on mass email sending.
Compliance and Legal Protection: Xania Hosting implement these blocks to comply with anti-spam regulations and to protect themselves from legal issues related to spam originating from their networks.
Resource Management: Mass email sending can consume significant bandwidth and server resources, potentially affecting other customers' performance.
Port 465 (SMTPS - SMTP over SSL) is often blocked for similar reasons, as it's another common port used for email transmission.

4. Data Sharing: The Company will not share personal data with third parties except as necessary for the provision of the Services or as required by law. All third parties will be bound by similar data protection obligations.

5. Data Retention: Personal data will be retained only for as long as necessary to fulfill the purposes for which it was collected or to comply with legal, regulatory, and internal data retention policies.

IV. User Responsibilities

1. Protection of Access Credentials: Users must protect their login and authentication credentials to prevent unauthorized access to their account and personal data.

2. Accuracy of Data: Users are responsible for providing accurate and current information essential for the efficient delivery of Services.

VI. Data Transfers

The Company may transfer personal data to other countries, provided that such countries have data protection laws ensuring an adequate level of protection that complies with applicable regulations.

VII. Amendments

This Agreement may be amended by the Company at any time with reasonable notice to Users, reflecting changes to data protection practices or legal requirements.

VIII. Dispute Resolution

1. Governing Law: This Agreement shall be governed by the laws of the jurisdiction in which the Company is legally established.

2. Arbitration: Any disputes arising out of this Agreement shall be resolved through binding arbitration under the rules of the American Arbitration Association or another agreed-upon arbitrator.

IX. Term and Termination

This Agreement will remain in effect as long as the User continues to utilize the Services or maintains an account on the Website. Upon termination, certain obligations related to personal data and confidentiality are intended to continue in effect beyond termination.
